This User Agreement (the "Agreement") is entered into by and between you ("User" or "you") and F Trade Markets, a company incorporated in Saint Lucia with registration number 2025-00035 (the "Company," "we," "us," or "our").

Before you register for or use the KIFX mobile application and all related services (collectively, the "Service"), you must carefully read and fully understand this Agreement, especially the sections concerning disclaimers and limitations of liability, which are highlighted in bold.

By downloading, registering, accessing, or using the Service, you signify that you have read, understood, and agree to be bound by all terms of this Agreement.

1. Nature and Scope of Services

  • 1.1. Informational and Educational Platform: KIFX is an educational and informational tool focused on providing financial market information, news alerts, market analysis, and trading strategies.
  • 1.2. Simulation Trading Feature: The Service includes a trading simulation feature (the "Demo Trading"). This feature is for educational and practice purposes ONLY. All transactions use VIRTUAL funds and do not involve the deposit, withdrawal, or trading of any real money. The performance and results in the simulation do not represent or guarantee any returns in real-world trading.
  • 1.3. No Financial Services: The Company is not a broker-dealer, financial advisor, or fiduciary. We do not provide account opening for real trading, asset management, or any regulated financial services.

2. IMPORTANT DISCLAIMER: NO INVESTMENT ADVICE

You expressly understand and agree that all content provided by KIFX, including but not limited to trading strategies, market analysis, news, data, technical indicators, or any other information, is for general informational and educational purposes only and DOES NOT CONSTITUTE investment advice, financial advice, trading advice, a recommendation, or a solicitation of any kind.

  • You should not rely on any information provided by us as the sole basis for making an investment decision.
  • We do not warrant the accuracy, completeness, timeliness, or suitability of any information.
  • You bear all risks associated with any decisions made based on the information provided by the Service. Before making any real-world investment, you should conduct your own independent research, consider your financial situation and risk tolerance, and consult an independent professional financial advisor.

3. User Account

  • 3.1. Eligibility: You must be at least 18 years of age to use the Service.
  • 3.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials (e.g., username and password) and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
  • 3.3. User Conduct: You agree not to use the Service for any unlawful purpose or to post any content that is misleading, offensive, or infringes upon the rights of a third party.

4. Intellectual Property

All content within the Service, including software, text, graphics, trademarks, and data, is the intellectual property of the Company or its licensors. You may not copy, modify, distribute, or use any of this content for commercial purposes without our prior written consent.

5. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any direct or indirect loss or damage arising from:

  • Your reliance on any information provided by the Service.
  • Any interruption or error in the Service due to network delays, system failures, viruses, or other technical issues.
  • Any virtual profits or losses generated within the Demo Trading feature.

6. Termination

We reserve the right to suspend or terminate your access to the Service at any time and for any reason, including but not limited to a breach of this Agreement, without prior notice.

7. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Saint Lucia. Any dispute arising from or related to this Agreement shall be resolved through friendly negotiation. If negotiation fails, the dispute shall be submitted to a court of competent jurisdiction for resolution.
